ClockWork Recruitment Privacy Policy: Updated Friday 9th September 2016

ClockWork has put together this privacy policy in order explain privacy practices for our website (www.clockworkapp.co.za) and our mobile applications. This policy explains how we collect and use your personal information through the website, services and the ClockWork mobile application (collectively, the “Service”). By using the Service, you consent to the collection and use of your information by ClockWork in accordance with this privacy policy and our Terms of Service. A user of the Service is hereinafter referred to as a “User,” or collectively, the “Users.”

ClockWork will take all reasonable steps to protect the confidentiality of its subscribers’ information, and use its subscribers’ information only for the purpose permitted or required.

  1. Personal Information

 

ClockWork collects and processes the following personal information about you only if you voluntarily choose to share such information with ClockWork:

Information such as your name, address, phone number and email address, which you provide by completing forms through the Services, upload or submit any material via the Services or request any information from us;

In connection with an account sign-in facility, your log-in and password details;

Communications you send to us, for example to report a problem or to submit queries, concerns or comments regarding the website, Services or its content;

We may also require you to provide us with your financial information, including billing name, address and credit card number (“Financial Information”) where you choose to use our Services.

Information from surveys, promotions and competitions that we may, from time to time, run on the website, if you choose to respond to, or participate in them;

Information relating to your real-time location;

Information that you post in the form of comments and reviews about other Users.

Video/Photos you may upload, job categories and desired hourly rate and other information we may suggest or you decide to upload to your Profile

 

  1. Payment Processing

 

Our payment processing provider, currently Peach Payments Ltd, also collects your name, company name, location, email address, phone number and account password, to set up your account, your business and personal tax, social insurance, or other government-issued identification numbers, as well as your date of birth, to verify your identity for underwriting purposes, your bank account information, to settle funds for your transactions and your IP addresses, devices, and locations used to access Peach Payments, which will be linked to your account for fraud detection/prevention purposes. Peach Payments use the data to process payments and for other purposes set out in their own privacy policy, which you can find here. You are under no obligation to provide any such information to us. However, you may not be able to take full advantage of particular opportunities provided through the Service.

 

  1. IP Address

 

When you visit and interact with the website and applications, ClockWork and/or third parties with whom ClockWork has contracted to provide services to ClockWork may automatically collect your Internet Protocol Address (“IP Address”), which is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. This number is identified and logged automatically in our server log files whenever you visit the website, along with the time(s) of your visit(s) and the page(s) that you visited. We use IP Addresses to monitor the regions from which Users navigate the website and for fraud prevention purposes.

  1. How does ClockWork use your information?

ClockWork will gather, store and use personal information you provided to us on the website or application for the following purposes:

To greet you when you access the site;

To communicate with you and to inform you of promotional offers and competition;

To inform you of any changes to the website, our terms or the services provided on the website that may affect your account;

To gather or create non­personal statistics about internet habits, click patterns and access to the website;

To verify your identity when you transact through the website.

ClockWork will only release its subscriber’s information to a third party under the following circumstances:

When directed by the written instruction of the subscriber or prospective subscriber;

When directed by an order of Court or other competent authority;

Where it is necessary to properly deal with and comply with any legislative enactment or regulation in respect of any complaint lodged in terms of ClockWork’s complaints handling procedure;

During the process of debt collection;

To ClockWork’s attorneys in connection with any potential, threatened or actual litigation;

To ClockWork’ auditors for the purpose of auditing their accounts; and

In terms of any applicable law.

  1. Cookies

Some of our web pages utilise “cookies” so that we can provide you with more tailored information when you return to our site. “Cookies” are used to enhance your interactive experience and generally improve the service which we offer you. You can set your browser to notify you when you receive a cookie, to decide whether or not to accept it.

  1. Choice/Opt-Out

 

You may opt out of receiving communications from us and our partners, remove your information from our database and choose to not receive future communications unrelated to the Service. During registration, you choose whether to receive correspondence from either the Company or its partners and whether you want to participate in a variety of Company programmes (by checking or unchecking the relevant box). This information remains on your Profile where you can, at any point, easily edit it to indicate that you have changed your mind. After logging in, click on your profile and navigate to “settings”. You can adjust your notification preferences here. We may occasionally contact you with information about special events, sales, activities, promotions, contests, submission opportunities and programmes. You always have the option to ask the Company not to contact you with this information again.   1. ClockWork security of collected information

 

Your ClockWork account is password-protected so that only you and authorised Company staff have access to your account information. In order to maintain this protection, please do not give your password to anyone. If someone represents to you they are Company staff and asks for any personal account information, including your password, check their URL. If it any communication is not from an @clockworkapp.co.za address, they are not. Also, if you share a computer or use a public computer, you should sign out of your ClockWork account and close the browser window before someone else logs in. This will help protect your information entered on public terminals from disclosure to third parties. Only certain authorised Company staff can access personal information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, the Company cannot guarantee the security of any information you transmit to us, and would like to remind you that whilst we endeavour at all times to maintain the security of all information, you are doing so at your own risk.

 

  1. Who does ClockWork share information with?

 

When you submit information to the Company, it is collected, processed and maintained solely by us or by third-party agents who are bound by privacy restrictions at least as restrictive as those set forth in this policy. We may allow, with your consent, carefully selected third parties to send you information directly which you may find useful regarding their products and services. Some ClockWork content may be “sponsored by” or “presented by” other companies. ClockWork may share aggregated, anonymous data collected via the website, applications, or via email surveys with third parties. This information is not linked to specific users. The Company may disclose Personal Information from both private and public areas of this website at our discretion, if required by law or by a court order, or if we are given reason to believe, based on our sole discretion, that someone is causing injury to or interference with the rights of Users, the general public or the Company. Finally, in the event that the Company undergoes a re-organisation or is sold to a third party, the Company reserves the right to transfer, sell and/or distribute all information collected through the Service to an affiliate, subsidiary, or third party.

 

  1. How can Users edit their information?

 

Legally upon request, we will provide you with a copy of this information, subject to a fee not exceeding the prescribed fee permitted by law. You also have a right to correct any errors in any information we hold about you. To update your personal info, click on your profile where you will be able to view, update and correct your account information. You may edit your account information at any time. So that we can protect the integrity of sensitive data, there are certain pieces of information, such as your age, that you cannot alter yourself. For example, since children under 18 are not allowed to register as Users, we need to take reasonable measures to preserve the accuracy of our Users’ ages. Our databases automatically update any Personal Information you edit in your profile, or that you request we edit. Information transmitted through boards, chats, polls or through any other means remains in our databases and becomes the property of the Company upon submission.

 

  1. Notification of changes

 

The Company’s security and privacy policy are periodically reviewed and enhanced as necessary. This policy might change as the Company updates and expands the Service. The Company will endeavour to notify you of these changes by email, but will not be liable for any failure to do so. The Company also encourages you to review this privacy policy periodically. The Company’s staff will respond to all requests sent through email from Users interested in knowing more about what personal information is stored on the Company’s database, or if they want their personal information nullified, or have additional questions regarding privacy.
